TxDOT DBE Reevaluation Update: What Firms Need to Know in 2026

Texas transportation firms participating in the Disadvantaged Business Enterprise (DBE) or Airport Concessions Disadvantaged Business Enterprise (ACDBE) programs are navigating a statewide reevaluation process following a federal rule change.
What Changed Under the New DBE Rule?
The U.S. Department of Transportation issued an interim final rule in October 2025 that changed how DBE and ACDBE eligibility is evaluated. The rule removed race- and sex-based presumptions and requires qualifying owners to demonstrate social and economic disadvantage using individualized evidence.
In response, the Texas Unified Certification Program (TUCP) began reevaluating Texas-certified firms under the new criteria.

The TxDOT DBE reevaluation update issued in June 2026 says Texas has concluded its centralized document-deadline phase and is transitioning reevaluation responsibilities back to TUCP certification partners.
Key points for firms:
Firms that already submitted documents will continue through review.
Firms certified as of October 3, 2025, that have not submitted reevaluation documents may still submit them and are encouraged to act promptly.
Firms are delisted from the TUCP directory while reevaluation is pending and are reinstated after successfully demonstrating eligibility.
New and interstate certification activity is expected to resume as the transition progresses.
TxDOT stated that DBE project goals are unlikely to resume before January 2027.
What Should Affected Firms Do Now?
Confirm which TUCP agency holds your certification and monitor that agency’s portal and communications. If your reevaluation package has not been submitted, review the current TxDOT instructions promptly.
The required materials generally include:
A personal narrative with supporting documentation
A personal net worth statement
The most recently filed personal income tax return, including schedules and W-2s
A current personal bank statement
Firms should use the official forms and instructions. TxDOT specifically states that TUCP certification partners do not charge for reevaluation and cautions firms about paid assistance with the personal narrative or personal net worth statement.
