October 16, 2026 | Tax Law Update

The Internal Revenue Service (IRS) announced on October 16, 2026, that it has begun issuing automatic refunds to more than 50,000 taxpayers who previously claimed adoption tax credit carryforwards.

The refunds follow a clarification of federal tax law affecting the refundable portion of the adoption tax credit for the 2025 tax year.

Most eligible taxpayers will not need to file an amended tax return to receive the additional refund.

What Changed?

The adoption tax credit helps eligible taxpayers offset qualified expenses associated with adopting a child.

Beginning with the 2025 tax year, federal legislation made up to $5,000 of the adoption tax credit refundable per qualifying child, subject to applicable limitations.

The IRS has now clarified that, for tax year 2025 only, certain unused adoption tax credits carried forward from 2020 through 2024 may increase the refundable portion of the 2025 credit.

This change could result in additional refunds for taxpayers whose original 2025 returns did not reflect the newly clarified treatment.

Who May Qualify for Adoption Tax Credit Refunds?

Taxpayers who previously claimed the adoption tax credit may be eligible if they:

  • Had unused adoption tax credits carried forward from 2020 through 2024.

  • Filed a 2025 federal income tax return.

  • Had eligible carryforwards that may increase the refundable portion of their 2025 adoption credit.

The actual refund amount depends on each taxpayer’s circumstances and applicable credit limitations.

Not every qualifying taxpayer will receive a $5,000 refund. Some adjustments may result in a smaller refund, a reduction in taxes owed, or no additional payment. An adjustment may also be applied toward another tax or non-tax debt.

Do You Need to Amend Your 2025 Tax Return?

Generally, no.

The IRS is identifying affected taxpayers and automatically adjusting their accounts. Taxpayers who filed their 2025 returns before April 15, 2026, generally do not need to take additional action.

Returns filed under extension and accounts involving identity verification, dependency conflicts, or other processing issues may require additional review after the return is processed or the account issue is resolved.

The IRS expects most eligible adjustments to be completed by the end of 2026.

What Should Taxpayers Do?

  1. Monitor your IRS account. Review your tax account for adjustments or refund activity.

  2. Watch for an IRS notice. The IRS generally expects to issue notices within 30 days of an adjustment. Compare the notice with your 2025 return.

  3. Retain your documentation. Keep your IRS notice, Form 8839, and adoption credit carryforward records.

  4. Review future-year implications. An adjustment to your 2025 credit could reduce the adoption credit carryforward available for future tax years.

Why This Matters for 2026 Tax Planning

Although the automatic adjustment applies to 2025 tax returns, it may also affect adoption credit carryforwards used when preparing 2026 returns.

Taxpayers with unused adoption credits should review their updated carryforward calculations before filing their next return. Properly tracking tax credit carryforwards can help prevent filing errors and ensure available tax benefits are accurately reported.
